The Cloudsail Project - Terms of Use

1. Acceptance of Terms and Privacy Policy
By accessing or using any services, servers, or websites provided by The Cloudsail Project ("Cloudsail," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). These Terms expressly incorporate our Privacy Policy by reference. If you do not agree to all terms and conditions, you may not access our services. We reserve the right to update these Terms; however, we will provide reasonable notice of any material changes via an announcement on our official Discord server or a website banner. Your continued use of the services following such notice constitutes your acceptance of the changes.
2. User Eligibility & Age Restrictions
You must be at least 13 years of age to access or use our services. By using Cloudsail, you represent and warrant that you meet this requirement. If you are between the ages of 13 and 17, you must have the legal consent of your parent or guardian to accept these Terms and to make any financial contributions or donations.
3. Description of Services & "As-Is" Provision
Cloudsail provides public-facing game servers, cloud infrastructure, and community platforms. All services are provided strictly on an "AS IS" and "AS AVAILABLE" basis.
No Service Level Agreement (SLA): We do not guarantee continuous, uninterrupted, or secure access to our servers.
Data Loss: We are not responsible for lost server progress, corrupted files, downtime, or scheduled/unscheduled maintenance. You use the infrastructure entirely at your own risk.
4. Donations, Digital Goods, and Fiscal Sponsorship
The Cloudsail Project operates as a fiscally sponsored project of the Hack Foundation, a registered 501(c)(3) nonprofit organization. Our infrastructure is funded through voluntary user donations.
Perks and Ranks: Donors may receive digital cosmetic ranks or in-game perks as a gesture of appreciation. These perks are delivered via an automated API system. We do not guarantee immediate delivery in the event of technical outages.
Fair Market Value & Tax Deductibility: Under IRS regulations, the tax-deductible amount of your contribution is limited to the excess of the donation over the fair market value of any goods or services received in exchange. Digital cosmetic ranks hold no real-world financial value.
No Pay-to-Win: Perks provide no competitive advantage in-game.
Refund Policy: All donations are final, non-refundable, and non-transferable. Chargebacks or payment disputes will result in an immediate, permanent ban from all Cloudsail services and infrastructure.
5. Third-Party EULAs and Affiliation
The Cloudsail Project is an independent organization. We are not affiliated with, endorsed by, maintained by, or supported by Microsoft Corporation, Mojang AB, or Team Cherry.
By accessing our servers, you acknowledge and agree to comply with the respective End User License Agreements (EULAs) and Terms of Service of the underlying software, including but not limited to the Minecraft EULA.
Any registered trademarks used on our platforms are the property of their respective owners.
6. User-Generated Content (UGC) and Licensing
While you retain the underlying copyright to original structures, builds, or modifications you create within the Cloudsail game servers, by building on our platforms, you grant The Cloudsail Project a broad, irrevocable, royalty-free, worldwide license to host, display, modify, and distribute your creations within the server environment.
If your access is revoked or terminated, you forfeit any right to access, export, or demand the deletion of your in-game content.
We reserve the right to retain, modify, delete, or use screenshots and videos of user-generated content for promotional or administrative purposes.
7. Account and Network Responsibility
You are strictly and solely responsible for all activity that occurs under your account and originating from your IP address. We enforce server rules via IP and account-based bans. We do not entertain appeals based on claims that an account or network was accessed by a sibling, friend, or unauthorized third party. It is your responsibility to secure your own network and account credentials.
8. Limitation of Liability and Indemnification
IN NO EVENT SHALL THE CLOUDSAIL PROJECT, ITS DIRECTORS, ADMINISTRATORS, OR VOLUNTEERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR INFRASTRUCTURE OR SERVICES.
This includes, without limitation, damages for loss of data, loss of in-game progress, server downtime, unauthorized access to your account, or actions taken by other users.
You agree to indemnify, defend, and hold harmless The Cloudsail Project from any claims, liabilities, damages, or expenses (including legal fees) arising from your violation of these Terms or your misuse of the services.
9. Termination of Service
Access to Cloudsail infrastructure is a privilege, not a right. We reserve the absolute right to suspend, terminate, or permanently revoke your access to any and all Cloudsail services, game servers, and community platforms at our sole discretion, at any time, and for any reason, without prior notice or liability.
10. Governing Law, Jurisdiction, and Hybrid Disputes
These Terms of Service, and any disputes arising from your use of The Cloudsail Project's infrastructure, game servers, or community platforms, shall be governed by the laws of the State of Arizona. Any legal action regarding infrastructure usage or moderation decisions shall be brought exclusively in Arizona.
Financial Transactions: All financial donations, tax-deductible contributions, and payment processing are governed by the Terms of Service and legal jurisdiction of the Hack Foundation and its payment processors.
Hybrid Disputes: In the event a dispute involves both a financial transaction and infrastructure access (e.g., an account ban resulting from a payment chargeback), matters pertaining to the revocation of server access shall remain exclusively under Arizona jurisdiction, while the financial mechanics of the transaction remain under the Hack Foundation's jurisdiction.
